What is Land Consolidation?
Land consolidation refers to the legal process of reallocating pieces of land to obtain larger pieces of land at one or more places in exchange for the former smaller and fragmented land plots previously owned.
Land consolidations are usually applied to form more extensive landholdings. It is often used to improve rural infrastructure and implement developmental growth.
What are Sectional Consolidation & Partitions?
The developer determines how the sectional plan divides the buildings into sections and common property. An owner not satisfied with this may decide on consolidating or combining two or more sections into a single unit or subdividing one large section into two or more units. Section 21 of the Sectional Titles Act 95 of 1986 requires owners wanting to consolidate or subdivide the section they own to submit their decision to the body corporate for consent. Once the trustees give permission, the architect or land surveyor offers an adjusted draft sectional plan to the Surveyor General. For the Surveyor General to approve, the draft sectional plan must follow the stipulations of the Act and all the relevant documents submitted.
WHAT IS THE PROCESS TO FOLLOW IN THE REGISTRATION OF SECTIONAL CONSOLIDATIONS?
In sections 22 and 23 of the Sectional Title Act, owners can apply to the Registrar of Deeds to register the sectional plan of subdivision or consolidation. This application is accompanied by:
Two copies of the adjusted sectional plan
The sectional title deed
Mortgage bond to which the section may be subject, consent of the mortgagee for the subdivision or consolidation and registration, or any sectional mortgage bond registered against the sections,
Original documents of the registered sectional title deed.
A registration certificate of the amended new sections
Other documents and particulars as needed.
After the abovementioned requirements are complied with, the Registrar registers the sectional plan of subdivision/consolidation, furnishes a copy of the sectional plan of subdivision/consolidation to the local authority concerned and notifies the Surveyor-General of the registration. The Surveyor General amends the original sectional plan and issues the deeds office with a copy of the sectional plan to reflect the changes.
Upon registration of the sectional plan of consolidation, the sections are now a single section. The Registrar must, together with the sectional title deed relating to this section, issue the certificates of registration which supersede the previous registrations.
