All assets, income and liabilities of a deceased person are referred to as a deceased estate.. Once a death is reported to the Master of the High Court,   an executor or a Master’s representative is nominated and appointed, depending on the value of the estate, to administer the deceased estate. The Executor is not liable for the debts of the deceased estate but is instead mandated to act on behalf of the estate in winding up its financial affairs.

The deceased’s estate carries the responsibility of paying debts and claims filed against the deceased estate using the assets in the estate. After someone dies, anyone owed money or property by the deceased can file a claim against the estate. Estate claims range from debt types such as credit card debt, loans, mortgages, unpaid wages, breach of contract, etc. The appointed Executor will deal with all matters and claims against the deceased estate. WHAT IS THE DECEASED ESTATE CLAIM PROCEDURE?

A claim against a deceased estate can be brought in accordance with the Administration of Estates Act 66 of 1965. The prominent provisions of the Act are the following:

  • After a letter of executorship has been granted, the Executor has a notice published in the Government Gazette and a newspaper, calling upon persons having claims against the deceased estate to lodge these claims within a specified period.

  • After that, creditors must submit their claims in the prescribed form and within the specified period.

  • The Executor is obligated to submit a liquidation and distribution account within six (6) months from date of appointment, indicating if a particular claim is admitted.

  • The liquidation and distribution account lies with the Master of the High Court for a period of 21 days, during which period, any creditor may file an objection with the Master for any rejected and/or outstanding claims.

  • The Executor is then allowed to respond to the objections.

  • The Master’s ruling can be reviewed by a High Court motion application within 30 days.
