The eviction of an unlawful occupier is governed by The Prevention of Illegal Eviction from and Unlawful Occupation of Land Act 19 of 1998 (PIE Act). WHAT IS THE EVICTION PROCEDURE IN SOUTH AFRICA?
NOTICE OF EVICTION
Your attorney notifies the unlawful occupants of the property owner’s eviction intent. An application is brought before the court to have an eviction letter served on the occupants. The occupant can ignore the eviction letter, oppose it, or move out. The occupant has five days to object in writing to the property owner or the representing attorney. The occupant has a notice period of 14 (fourteen) court days. If there is no response, an ex parte application for directions for serving and the hearing date, as envisaged in Section 4(2) of the PIE Act.
ORDER OF EJECTMENT
Once the notice period has lapsed, the property owner can apply for an ‘ejectment order’ authorising the Sheriff of the Court to remove unlawful occupants from the property. Evicting an illegal occupant is complex, and getting an eviction order without an attorney is almost impossible. If one does not adhere to eviction steps, the delay process causes a more significant loss of income.
