WHAT DOES THE ADMINISTRATION OF DECEASED ESTATES ENTAIL IN SOUTH AFRICA?

Administering a deceased estate requires specialised skills and insight by specialist deceased estate attorneys. Administering a deceased estate is not a task that should be approached lightly or by someone who does not have a working knowledge of what to do which can only cause unnecessary delays and more harm than is necessary.

When a person dies, the Executor of the deceased estate must complete a death notice and report it to the Master of the High Court within 14 days. The Master registers the deceased estate and formalises the appointment of the nominated Executor with a Letter of Executorship which authorises the Executor to represent the deceased estate.

WHAT ARE THE EXECUTOR’S DUTIES IN ADMINISTERING A DECEASED ESTATE?

The appointed Executor is responsible for administering the deceased estate in terms of the Administration of Estates Act 66 of 1965. Their duties are stipulated as follows:

  • Get an appraiser’s valuation of the assets and pay all the estate’s debts.

  • Opens a bank account on behalf of the estate.

  • Prepares the estate’s Liquidation and Distribution Account, which is a written report addressed to the Master of the High Court, heirs and creditors, stating the process of collecting and realising the assets, the discharge of debts, and the handing over of what remains to the heirs of the deceased estate.

  • Submits the final tax returns to SARS, paying all Inheritance Tax like Capital Gains Tax and other taxes.

  • Advertises the Liquidation and Distribution Account. This advertisement is a Section 29 advert where you advertise in the local papers and the government gazette giving notice to creditors & debtors).

  • Send Letters of Executorship to all persons of interest.

  • Establishes liquidity of the estate.

  • Distributes the assets as specified in the will.

  • Transfers and distributes the property to the heirs.

  • Sign off all documents, close the estate bank account, and obtain the final discharge from the Master of the High Court.
